1.2. Unless the context requires otherwise, words in the singular include the plural and words in the plural include the singular.
2.1. The Services allow Users to purchase virtual currencies using fiat currency.
2.2. The Services may be accessed via third-party web portals or through cash-in terminal interfaces. Legal entities can integrate Meadow Link’s software or use it as a white-label solution on their own platforms (such as websites or cash-in terminals) to provide their end-users with direct access to Meadow Link’s Services. Any such integration by a legal entity requires an appropriate mutual services agreement between Meadow Link and that entity.
2.3. Depending on your country of residence or location, you may not be able to use some or all of the Platform’s Services. It is your responsibility to comply with the laws and regulations of your country of residence and of any jurisdiction from which you access the Site or Services.
2.4. Due to the nature of virtual currency wallet addresses, once a Transaction has been initiated, it is not possible to refund the payment, modify the wallet address, or re-enter a new wallet address. Users must understand and accept this fact before initiating any Transaction.
3.1. The User has the right to access and use the Site and Services only if they voluntarily agree to and comply with these Terms of Use. By using the Site, you indicate that you accept and will abide by all the terms and conditions outlined in this document.
3.2. You agree to read the entirety of these Terms of Use carefully before using the Site or any of the Services provided by Meadow Link.
3.3. You agree to follow all laws and regulations that apply to your use of the Services.
3.4. If you conduct a one-time Transaction (as defined by the Counteracting ML/TF Act) below the applicable threshold specified by our AML/CFT procedures, these Terms of Use still fully apply to you, even if no ongoing business relationship is established and no Account is created for that Transaction.
3.5. You agree to keep track of any changes or requirements in the transaction process, including but not limited to any requests for additional information or documents needed to complete a Transaction.
3.6. You must immediately notify Meadow Link if you notice any unusual, suspicious, unclear, or abnormal changes in any Transaction or in your Account. If you fail to promptly report such issues or withhold relevant information, you will be considered in breach of these Terms, and Meadow Link may take appropriate actions, including but not limited to reporting the matter to relevant state or national authorities.
3.7. You are not allowed to maintain more than one Account. You are solely responsible for safeguarding your Account credentials (such as your password) and for protecting all information, activities, and transaction history associated with your Account.
3.8. You acknowledge that when a Transaction is executed, the Platform facilitates the transfer of the paid amount from the Buyer and then delivers the corresponding virtual currency to the wallet address specified by the Buyer.
3.9. You agree to immediately inform Meadow Link (via the designated support email address provided on the Site) of any unauthorised use of your login credentials or any security breach related to your Account. Failure to do so may result in termination of your access to the Services, and you may be held liable for any losses incurred by Meadow Link or other users of the Platform due to your negligence.
3.10. You must not use the Services for any form of criminal or illegal activity, including but not limited to money laundering, illegal gambling operations, financing terrorist organisations, or malicious hacking.
3.11. You will be responsible for any damages and all legal claims or actions brought against Meadow Link that arise from your violation of any third-party rights or your breach of any applicable laws.
3.12. Nothing in these Terms of Use limits or excludes your liability for fraud, or for death or personal injury caused by your negligence, breach of legal duty, or any other liability that cannot be limited or excluded under applicable law.
3.13. You alone are responsible for determining whether any Transaction you consider undertaking is appropriate for you in light of your personal objectives, financial situation, and risk tolerance.
3.14. Any payment method you use for a Transaction (whether a bank account, credit card, debit card, or otherwise) must be in your own name. Using any payment instrument that is not registered in your name will be considered fraudulent.
4.1. By initiating any Transaction, you expressly represent and warrant that:
4.1.1. You are at least 18 years old and have the legal capacity to accept these Terms of Use and to engage in transactions involving virtual currency.
4.1.2. You have read and agreed to these Terms of Use.
4.1.3. You will comply with the laws and regulations of your country of residence and any country from which you access the Site or Services.
4.2. You represent and warrant that you will only use the Platform to carry out Transactions as permitted by these Terms, and that you are fully authorised and have the legal capacity to conduct Transactions on the Platform.
4.3. You represent and warrant that any fiat funds you use to purchase virtual currency are your own and come from lawful sources.
4.4. You represent and warrant that none of your Transactions will violate any third-party rights or any applicable laws.
4.5. You understand that your personal data and identification information may be disclosed to authorised third parties if required by law (for example, for the prevention of crime or for tax purposes) or as necessary to provide the Services you request.
5.1. Meadow Link reserves the right to suspend any Transaction and to freeze any virtual currency (before it is transferred to the User’s wallet) or any fiat funds involved in the Transaction if the User fails to comply with, or improperly fulfils, these Terms of Use.
5.2. Meadow Link will provide the Services with due care and diligence and in accordance with these Terms of Use.
5.3. Meadow Link’s responsibilities are limited to using reasonable technical measures to ensure that virtual currency is successfully transferred to the User. When we send virtual currency to the wallet address you provide, our responsibility is limited to properly transmitting the necessary technical transaction data to the relevant virtual currency network.
5.4. To the extent permitted by law, Meadow Link will not be liable for any damages, lost profits, lost revenue, business interruptions, loss of opportunities, loss of data, or any indirect or consequential losses, except to the extent that such losses are caused directly by Meadow Link’s breach of these Terms of Use.
5.5. Meadow Link is not responsible for any damage, lost profit, lost revenue, business interruption, or any indirect or consequential loss you may incur as a result of using third-party services. This includes cases where third parties have integrated Meadow Link’s Services into their own platforms (such as websites or terminals) under a mutual services agreement.
5.6. Meadow Link is not liable for any malfunctions, breakdowns, delays, or interruptions of internet connectivity, or for any other reasons that the Site may be temporarily unavailable.
5.7. Meadow Link is not responsible for any delays in processing payments that are caused by third-party operators or payment systems involved in the transactions.
5.8. If fraud or other illegal activity is suspected, Meadow Link will cooperate with competent authorities and provide all necessary information (including names, addresses, and other requested details) to those authorities. You acknowledge that your Account or Transactions may be frozen at the request of law enforcement or other authorised agencies investigating fraud or other illegal activities.
5.9. Nothing in these Terms of Use limits or excludes Meadow Link’s liability for its own fraud, or for death or personal injury caused by our negligence, breach of statutory duty, or any other liability that cannot be limited or excluded under applicable law.
6.1. All content on the Site is the exclusive property of Meadow Link (unless otherwise indicated) and is protected by copyright, patent, trademark, and other applicable intellectual property laws.
6.2. All trademarks, trade names, service marks, and logos used on the Site (collectively, the “Trademarks”) are owned by Meadow Link or by their respective owners. In addition, all software, applications, text, images, graphics, data, pricing information, trades, charts, graphs, videos, and audio materials available on the Site are the property of Meadow Link. You may not copy, reproduce, modify, republish, upload, post, transmit, scrape, collect, or distribute any Trademarks or other content from the Site by any means (whether manual or automated) except as expressly permitted by us. Using any content from the Site on any other website or networked computer environment without our prior permission is strictly prohibited. Any unauthorised use of the content or Trademarks may violate copyright, trademark, patent, or other laws and could result in civil or criminal penalties.
6.3. Meadow Link respects intellectual property rights. If you need to submit a claim of infringement—whether (i) a trademark claim regarding a registered trademark or service mark that you own, or (ii) a copyright claim regarding material for which you hold a valid copyright—please contact us via the support email address provided on our Site.
7.1. Identification and verification procedures (commonly known as Know Your Customer or “KYC”) are required for all Transactions, unless the Transaction is an occasional transaction (as defined under the Counteracting ML/TF Act) that falls below the applicable threshold set by our AML/CFT procedures. If you refuse to provide the required documents or information for KYC verification (including any additional information we request after a business relationship is established), Meadow Link reserves the right to discontinue providing Services to you immediately.
7.2. You authorise Meadow Link to conduct any inquiries it deems necessary, either directly or through third parties, to verify the accuracy and relevance of the information you provide for verification purposes. Any transfer of your personal data to third parties will be limited to the essential information required, and appropriate security measures will be in place to protect your data.
8.1. The Platform enables Users to purchase virtual currencies through the Site.
8.2. You acknowledge that you should submit a payment order only after careful consideration, and you understand and accept the consequences of doing so. You agree that once a payment order is executed, the Transaction is irreversible and cannot be cancelled. Transactions are executed immediately and are considered to have occurred on the date and time they are processed.
8.3. You understand and agree that a Transaction may be delayed due to KYC verification or other compliance checks. You also acknowledge that, because of the characteristics of virtual currency networks, transferring virtual currency to your specified wallet address may take some time to complete.
8.4. If you detect any transaction activity that you did not initiate, you must promptly notify Meadow Link and follow our instructions. If you do not notify us promptly, Meadow Link reserves the right to freeze the funds pending the completion of an investigation.
8.5. Meadow Link may be required to annul or recall a completed Transaction at the request of a financial institution involved in processing that Transaction (including, but not limited to, banks). In such cases, you agree to cooperate with Meadow Link to determine the reasons for any such request.
9.1. Meadow Link reserves the right to establish and adjust Transaction Fees at its discretion.
9.2. Meadow Link does not control any exchange rates, processing fees, or additional charges that may be imposed by your bank, card issuer, or other payment provider. Therefore, Meadow Link assumes no responsibility for any such additional costs that you may incur.
9.3. You agree to pay the applicable Transaction Fee to Meadow Link for each Transaction that is successfully completed.
9.4. Meadow Link employs a rounding policy for financial calculations that may result in minor adjustments in favour of the Platform. Fiat currency amounts are rounded to two decimal places (the nearest cent, in most cases). Virtual currency amounts are rounded according to the standard precision for the specific virtual currency in question.
9.5. For operational efficiency, certain transactions on the Platform (including, but not limited to, conversions between currencies or cryptocurrencies) might not immediately appear in your Account. Such transactions will be recorded and visible only once the transaction amount reaches the minimum unit according to the applicable rounding policy.
10.1. Meadow Link may suspend or terminate your Account or cancel any Transaction at any time if we reasonably believe such action is necessary to comply with any law or with recommendations issued by a relevant government authority or recognised body aimed at preventing financial crime, money laundering, terrorist financing, or the proliferation of weapons of mass destruction.
10.2. Using the Platform for any unlawful purpose is strictly prohibited. Meadow Link will report any suspicious activity to the appropriate law enforcement authorities without delay.
10.3. You agree that you will not use the Services for any transactions involving or related to any of the following:
10.3.1. Money laundering, terrorist financing, or the proliferation of weapons of mass destruction.
10.3.2. Human trafficking.
10.3.3. Any goods or services that are illegal, or the promotion, offering, or marketing of which is illegal; any content that is illegal, obscene, or pornographic; any content involving the sexual exploitation of children or minors; or any content that promotes propaganda or symbols of unconstitutional organisations, glorifies war, or violates human dignity.
10.3.4. Any goods or services (or their promotion or sale) that infringe upon copyrights, industrial property rights, or other rights of any person.
10.3.5. Archaeological findings or artefacts protected by law.
10.3.6. Narcotics, illegal drugs, or hallucinogenic substances.
10.3.7. Weapons of any kind.
10.3.8. Illegal gambling services or operations.
10.3.9. Ponzi schemes, pyramid schemes, or any other fraudulent “get rich quick” schemes.
10.3.10. Goods that are subject to trade embargoes.
10.3.11. Media that is harmful to minors or violates any laws designed to protect minors.
10.3.12. Human organs, body parts, or human remains.
10.3.13. Protected animal species or protected plants.
10.3.14. Explosive materials or any kind of weapons (including components or accessories thereof).
10.3.15. Any other goods, services, or transactions that are illegal.
11.1. Meadow Link is an independent, self-governing company and has the authority to decide—based on its internal policies and regulatory obligations—whether to accept, restrict, or refuse to provide Services to any User.
11.2. Meadow Link conducts thorough screening of its Users and will take appropriate measures to prevent providing Services to individuals or entities from any Unsupported Countries.
11.3. By accessing and using the Services, you affirm that you:
11.3.1. Are NOT on any sanctioned party lists. This includes, but is not limited to, not being listed on the United Nations Security Council sanctions list, the European Union consolidated sanctions list, the U.S. Office of Foreign Assets Control (OFAC) Specially Designated Nationals list, or the U.S. Commerce Department’s Denied Persons List.
11.3.2. Are NOT a resident of an Unsupported Country.
11.3.3. Do NOT qualify as a “U.S. Person.” For the purposes of these Terms, a “U.S. Person” is generally anyone who meets any of the following criteria:
11.4. Any User who obtains access to the Services illegally or fraudulently, or who violates the restrictions outlined in this Section, is subject to immediate suspension of their Account without any refund of funds. Such a User will also be solely responsible for any legal consequences or actions by authorities that result from their conduct.
12.1. You are responsible for maintaining the confidentiality of your Account credentials. This includes, but is not limited to, your password and any other information related to your Account and all Transactions conducted through your Account.
12.2. Meadow Link staff will never ask you to disclose your password. If you receive any message or encounter any website (other than Meadow Link’s official Site) asking for your password, you should report it to us immediately. If you are unsure about the authenticity of a website, make sure the site has a valid security certificate (for example, look for the proper SSL security indicators in your web browser’s address bar).
12.3. We recommend that you change your password regularly (for example, every three to six months) to reduce the risk of unauthorised access to your Account. You should also choose a strong, unique password that cannot be easily guessed or associated with your personal information. Never allow anyone else to access your Account, and take care that no one can observe you entering your login credentials.
12.4. If you suspect that your Account, login details, password, or any other security feature has been lost, stolen, misused, or compromised, you should immediately change your password. You must also promptly contact our support team upon becoming aware of any loss, theft, or unauthorised use of your Account or any of your security credentials. Delaying notification to Meadow Link could endanger your Account and may result in you being held responsible for any losses that occur. If you believe someone unauthorised has accessed your Account, you should also notify the appropriate governmental authorities.
12.5. You should take reasonable precautions to secure your email accounts and ensure that only you have access to them. Your email address may be used for password resets and important security communications. Meadow Link is not liable for any breach of your email account that results in unauthorised Transactions (especially if those Transactions were confirmed through your compromised email). If any email address you use for your Account is compromised, you should immediately inform our support team and also contact your email service provider.
12.6. Whether you access your Account on a public computer, a shared device, or your own personal device, you must ensure that your login details are not saved or cached by the browser or device. Avoid using any feature that saves or remembers your passwords or login information on any computer or device you use to access the Services.
12.7. If you use additional products or services offered by Meadow Link, there may be specific security requirements or guidelines for those services. You are responsible for familiarising yourself with and following any such additional security requirements as they are communicated to you.
12.8. The use of two-factor authentication (2FA) is mandatory in order to initiate any withdrawal transactions from your Account.
13.1. You have the right to terminate this agreement (i.e. to stop using the Services and close your Account) at any time, provided that all pending transactions have been completed or cancelled.
13.2. Meadow Link also reserves the right, at its sole discretion and with prior notice, to terminate your access to the Site and your Account. This includes the ability to limit, suspend, or terminate the Services or your Account; to restrict your access to the Site (including any content, services, or tools); to delay or remove any hosted content; and to take technical or legal steps to block you from the Site.
We may take such actions if we determine that you are causing disruptions, creating potential legal liabilities, infringing upon others’ intellectual property rights, or otherwise acting inconsistently with the letter or spirit of these Terms of Use.
Additionally, Meadow Link may suspend or terminate your Account for any of the following reasons (among others), at our sole discretion:
13.3. Meadow Link further reserves the right to close any unverified or dormant Accounts, or any Account that has been inactive for twelve (12) months or more. We may also modify or discontinue parts of the Site or specific Services at any time. You acknowledge that Meadow Link will not be liable to you or any third party for terminating your Account or your access to the Site.
13.4. Termination of the business relationship or suspension of your Account will not affect any obligation you have to pay Transaction Fees for Transactions that have already been completed.
13.5. If a Transaction is canceled and our business relationship with you is terminated, any fiat funds that have been reserved or held for that Transaction (for example, in your payment card account) will be released in accordance with the rules of the relevant payment system and the card issuer. If the Transaction involved a cash-in terminal, you must provide valid bank account details so that the funds used in the Purchase can be returned to you. For Transactions conducted via other payment methods, Meadow Link will return the fiat funds to you as promptly as possible upon your request, and in any case within the timeframes we specify for such returns.
13.6. Meadow Link will send back to you any fiat funds used in a cancelled Transaction. Please be aware that multiple intermediary banks or payment providers may be involved in processing the return, and the beneficiary bank or those intermediaries might deduct charges or fees. Meadow Link will make reasonable efforts to inform you of such charges before initiating the return. However, if certain charges cannot be avoided or determined in advance, you acknowledge that you will be responsible for those charges, even if we could not inform you of the exact amount beforehand.
14.1. The Services are provided on an “as is” basis, without any warranties of any kind, either express or implied.
14.2. While Meadow Link strives to maintain the continuous functionality of the Site, you acknowledge that all online services can experience occasional disruptions or outages. Meadow Link is not responsible for any inconvenience or loss that you may suffer as a result of such interruptions. Accordingly, we do not guarantee uninterrupted access to the Site, nor do we guarantee that the Site will be free from delays, failures, errors, omissions, or loss of transmitted information.
14.3. Meadow Link will use reasonable efforts to ensure that the Site is generally accessible in accordance with these Terms of Use. In cases of scheduled maintenance, we may temporarily suspend access to the Site and will make reasonable efforts to provide advance notice of such maintenance. However, in emergency situations or other situations beyond our control, it may not be feasible to give advance notice.
15.1. Meadow Link reserves the right to send notifications to you and to communicate with you via any available means (such as email, SMS, phone calls, or notices within the Site), using the contact information you have provided.
15.2. You explicitly consent to receive communications from Meadow Link in electronic form, and you agree that all terms, conditions, notices, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You acknowledge that these electronic communications are legally binding.
15.3. The primary official channel for communications from Meadow Link is through our official website. Important information regarding the Services, changes to these Terms, or other announcements will be made available on the Meadow Link website.
16.1. These Terms of Use and any disputes or claims arising out of or relating to them (including non-contractual disputes or claims) are governed by the laws of Poland, unless expressly stated otherwise. All disputes or disagreements related to the Site or these Terms of Use shall be brought before the competent courts of Poland, with the District Court in Lodz serving as the court of first instance. If any provision of these Terms of Use is found to be invalid, void, or unenforceable under applicable law, that provision shall be deemed severable and will not affect the validity or enforceability of the remaining provisions of these Terms.
17.1. No Financial or Legal Advice. Meadow Link does not provide financial, investment, or legal advice in connection with its Services. Although we may provide information about the price, range, and volatility of virtual currencies, or events that may affect the price of virtual currencies, this information is provided for informational purposes only and should not be construed as investment or financial advice. You are solely responsible for any decisions you make to buy or sell virtual currency, and you understand that Meadow Link will not be liable for any losses you might incur as a result of your trading or investment decisions.
17.2. Tax Obligations. You are solely responsible for determining, reporting, and paying any taxes or duties that apply to your use of Meadow Link’s Services, in accordance with the laws of your country of residence. Meadow Link is not responsible for any violation by you of the tax laws applicable to you, including your failure to calculate or pay any applicable taxes or duties.
17.3. Indemnification. You agree to indemnify, defend, and hold harmless Meadow Link and its officers, directors, employees, agents, and third-party service providers from and against any and all claims, demands, expenses, costs, losses, liabilities, and damages (including reasonable attorneys’ fees) arising out of or related to:
This indemnification obligation will survive the termination or expiration of these Terms of Use and your use of the Site or Services.
17.4. Third-Party Links. The Site and Services may contain links to third-party websites that are not owned, operated, or controlled by Meadow Link. Meadow Link does not endorse and is not responsible for the content, terms and conditions, privacy policies, or practices of any third-party websites. We do not censor or otherwise control the content of third-party sites. By using the Site or Services, you release Meadow Link from any liability arising from your use of any third-party website. We strongly encourage you to be cautious when you leave our Site and to review the terms and privacy policies of any third-party websites that you visit.
17.5. Force Majeure. If Meadow Link is unable to perform any of its obligations under these Terms of Use because of circumstances outside its control (including but not limited to natural disasters, acts of God, acts of war or terrorism, civil disturbances, or changes in laws or government policies such as sanctions regimes), Meadow Link shall not be liable for the failure or delay in performing its obligations during the period of such unforeseen events.
18.1. Under no circumstances shall Meadow Link or its officers, directors, employees, agents, or any third-party service providers be liable to the User or any other person or entity for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever. This limitation of liability includes, but is not limited to, any damages resulting from:
18.2. This limitation of liability applies to any theory of legal liability, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Meadow Link has been advised of the possibility of such damages. You further acknowledge and agree that any cause of action arising out of or related to the Site or the Services must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action is permanently barred. In addition, in no event will Meadow Link’s total aggregate liability to you exceed the total amount you have paid to Meadow Link for the specific Service that is the subject of your claim. The limitations of liability in this Section shall apply to the fullest extent permitted by law and will survive any termination or expiration of these Terms of Use or your use of the Site or Services.
19.1. Meadow Link reserves the right to amend or modify these Terms of Use at any time. If we make any material changes, we will post the revised Terms of Use on the Site. Any such changes will become effective upon being posted on the Site, and will be deemed accepted by you the first time you use the Services after the new Terms of Use are posted. Any amendments or updates will apply only to activities or Transactions that occur after the updated Terms are posted.
19.2. If you do not agree with any modification to these Terms of Use, your sole remedy is to discontinue using the Services and close your Account. Meadow Link will not be liable to you or any third party for any loss or harm resulting from any modification of these Terms of Use. It is your responsibility to review the Terms of Use periodically so that you stay informed of any changes or updates made to them.
